Earned vs. "Borrowed" Vacation TIme

What is the name of your state (only U.S. law)? NY

My employer recently changed their vacation policy so that employees no longer receive all of their vacation time at the beginning of the calendar year. Now we "earn" 1/12th of our time each month. In addition, we can "borrow" up to 6 months of "unearned" vacation time, enabling us to use more time than we have actually earned. If we leave the company, we only get paid out for the unused "earned" amount, not the full amount that we are allowed to use at any given time. Also, if we leave the company and we have used more than we have earned, the difference will be deducted from our last paycheck. Is all of this legal? This is a large company with offices across the U.S.

There is no state anywhere in the US where you have to be paid out vacation that has not yet been earned or accrued, regardless of whether you can borrow against it or not.
