What is the name of your state (only U.S. law)? New York
I put in an offer on a home 2 years ago and gave the $1000 deposit which the bank cashed. The house was in short-sale and the bank would not respond to the real estate agents. I bought another home for more money than my offer on this house. They foreclosed on the owner of the home, relisted it and is in the process of selling it to someone else now for about $18k less than I offered because the house has deteriorated. They contacted my real estate agent and are going to be sending me a release form.
I would like to know what (if any) legal action I can take against them. I haven't seen the release form so I'm not sure yet what I'm legally releasing them from. By cashing my check does that in some way mean they accepted my offer in NY?

No, cashing the check didn't mean they accepted the offer but the bank has nothing to do with that anyway. The seller is out of the picture. The bank selling the house now was not the seller you were dealing with.


If you want your $1000, sign the paper. If you don't want it, don't sign.
