Hired excavator to prepare home site in June 2000. Earth movement - hillside behind home now approx. 6' from home foundation. Excavator won't repair without cost to me. Is he liable to repair at his cost?

My response:

No. An excavator only moves dirt. He is not a degreed soils engineer or geologist.

You should have had a soil inspection first to determine whether such excavation could safely be accomplished.
