I own a waterfront easement for access and all reasonable uses. It is a deeded easement stated to be free and unobstructed.A neighbor has claimed title ownership of the easement lands and represented to a New York State Agency that he is the owner of this land and that it is unencimbered and free of all easements. He has made this certification and mis-representation in order to obtain the Agency Permit to install boat docks on this waterfront. Does his actions constitute criminal fraud ? If so, who is the proper government agent to whom a criminal complaint should be made ?

Report this to the agency that grants permission to install docks. Provide copies of your easement documents. Ask them if you should file a complaint with anyone else. Also file an appeal of their decision if they've already granted permission. If N has permission already, obtin a temporary restraining order forbidding N from starting or continuing construction that interferes in any way with your easement rights.
