What is the name of your state (only U.S. law)? california

the county (napa) has an easement road that the very small neighborhood uses. the hospital has private water pipes running under the road that are corroded iron and collapsing under poorly paved road built over old dumping grounds. the pipes were not correctly covered with non-corrosive sands or packing materials. they are covered in rotting metal debris. leaks are springing up all over the road and now the county roads department is trying to say the garbage coming up under the road is the landowners' (us) problem to clean up. we have been trying to get this road closed as it is a single lane road on a very steep hillside with a few serious wrecks and injuries.

what can we do?

Well garbage trucks and other heavy vehicle traffic can contribute to roadway failutre, not to say it is the only cause of the problem. If there is a recorded easement, it would be nearly impossible to get the roadway closed. who owns the property or properties through which this easement runs?

road easement

thanks NC Aggie. we own the road with easement. the county roads guy kind of hints that if we make a stink, the environmental agency will come down on us. we didn't know there was a f(*#$&^$#!!! dump under the property when we bought it. there is an alternative way in and out, this small finger of the road is without merit. the other entrance/exit is in far better condition as well.

a huge firetruck rolled off the road and down our hillside last year, totaled. three months ago a mini van went off the road in the exact same location and the driver had to be medi-vact'd out.

it's ridiculous.
