easement to driveway

milford, ohio - my mother died and left house to children. i am refinancing the house to buy sibling's portion to live in the home. the title company needs me to have neighbor sign an easement because my driveway connects to their driveway, and there is no easement currently on file. after having lived this way for many years, can they say no? if so, what are my legal actions, if any, against them or the county or state? the only reason the driveway was moved over is because they had to move the street to allow the highway to go through. when this was done, there was no house next to us.

If they say no you can file for Court adjudication based on prescriptive easement.
