Easement

I am buying some property that has an easement on it. This easement is an old one. And the owner of the land that the easement goes to, has access to his land from another lot. The easement is for egress and ingress. Can he build a driveway on that easement? Right now there is no driveway. The land is in Georgia.

He can probably use the easement even though he has another driveway. You know the property better and can see if he's likely to want to build a road.

If this is a problem, either make vacating the easement a condition of closing, or close on the house and offer your neighbor $100 to convey the easement back to you. You write up a deed just like a sale, but only sell the easement. Record the deed and the easement is vacated.
