Ebay account suspension...wrongful?

I was a fairly new seller on ebay. I had successfully sold several items when on Friday, September 2, 2005, the one item I had listed was removed and my account suspended. The email I received did not say why the item was removed, only that it was removed pursuant to Section 9 of the user agreement. I immediately emailed ebay to ask why it was suspended but received no respnose. I emailed again 5 more times. I received one response but it did not answer my question. On one of my emails, I sent a copy of an email I received from a customer who asked why I wasn't on ebay anymore because our transaction was good and he wanted to buy more from me. I sent a copy of that email to ebay to show that my business was being hurt by the suspension. The response I received indicated that I was reporting my customer and they found that my customer's email was not dishonest or malicious. Ebay apparently totally misunderstand my intent. So, I emailed again making it very clear that all I wanted was to know why my account was suspended. I called general telephone support and they informed me that I would receive a response within 48 to 72 hours. I still have not received a response and it has been well over 72 hours. So, I emailed again asking again why my account was suspended. Still to no avail. I thought there might be one possible scenario and would like input from someone. One of my first items for sale was a camcorder. I used a stock picture from the manufacturer. I was warned by ebay that it was a copyrighted picture and could not use it. I immediately changed the picture and sold the camera. The only item I had for sell when my account was suspended was a 23" lcd television. Knowing that I could not use a stock picture, I used my own. The image on screen was a picture of nassau that my daughter took on her cruise to the Bahamas. It could be possible that the picture was thought to be a stock one and that I was inadvertently reported by the manufacturer. However, without knowing why my account was suspended, I cannot defend myself or my listing. I have tried everything I know to do. I refuse to open another ebay account and sell under a different name. I want only to fix the problem with ebay, whatever it is. Can someone here help me?

Breach.
Without limiting other remedies, we may limit your activity, immediately remove your bids or item listings, warn our community of your actions, issue a warning, temporarily suspend, indefinitely suspend or terminate your membership and refuse to provide our services to you if: (a) you breach this Agreement or the documents it incorporates by reference; (b) we are unable to verify or authenticate any information you provide to us; or (c) we believe that your actions may cause financial loss or legal liability for you, our users or us.

Being as you are new to eBay, it is most likely item (c) of the above. Due to huge amounts of fraud through eBay, they shut down many new users that are selling high end items. They have quite a backlog and it will take a few weeks to a month before they get back to you, sending multiple emails won't help. eBay has automatic triggers that flag new sellers and it appears you tripped enough of them. You will get a chance to explain your side, just be patient.

Thank you racer for your reply. Even though I am by nature impatient, perhaps due to my years being a paralegal and doggedly tracking down evidence, I will sit and wait to see what ebay does...for a time. Again, thank you for your time.

Or, it could be that you're dealing with one of the many STOOOPID Ebay cs reps. My account was "suspended" on 7/28 because someone hacked my password. I have bounced emails back and forth with them dozens of times trying to get it reactivated with a new password. So far...nothing. In fact, the last attempt resulted in me being told my account isn't "suspended" at all. "OK...then why can't I log on, you idiots...?" No answer.

If that is true, then they are taking care of the situation by ignoring me. Over a week later and I still have not received anything but the one response that did not even attempt to answer my question. Do you think they know they are wrong and are ignoring me hoping that I'll go away?

And aside from Dallas being a total idiot, E-Bay is a private business. There is NO requirement in law that would force them to allow you or anyone else access to their website, whether it be to sell, buy or browse.

Of course it is true that Ebay is a private business and does not have to allow me or anyone else to use it. However, their private business deals with the public and the fact that they are not required to allow me to use their site does not give them carte blanche to abuse their position. That is why there are governing authorities with respect to businesses and business practices. You cannot expect to do business with the public and not be accountable.

Why don't you get off that tired-as* attitude horse you rode back in on and shut down the stupid comments about OPs and other members. No one is amused by your childishness. If you are still crying because I wasn't impressed by your credentials, then be a man and keep your negative comments to yourself. Otherwise, stick to your legal advice and stop trying to be the bad boy of the boards.

No one cares...but it's time for you to grow up.

Just a quick note to say that eBay reinstated me and apologized for the honest mistake of suspending me. The best advice coming from racer72 was right. My activities put up flags but all is well now. Thank you racer72. You rock!!!
