Ebay and dishonest friend

Hi, this sounds really dumb but i'm going to make it short. Basically my "friend" used my ebay account without my explicit permission. He sold an item worth $1325 and the money was wired to his company's account. It has been 3 weeks and he still hasn't shipped the item out yet or refunded the money to the customer as he promised.

I have filed a police report about 2 weeks ago stating that he did this. I have email confirmation that the money did indeed (on my email account tho) go to his account and also, i have saved AIM conversation explicitly from him saying that he did indeed use my ebay account and clear shows that he's "responsible" for the transaction.

I have repeatedly asked him to refund the money, but he will not do so. What should i do?

How did he get a hold of the buyer to give them his business account information? How did he get the passwords to everything you have? Did you not know that it was for sale? I think you knew all along and now trying to get out of it. Your story doesn't hold water. You can be held liable, then it will up to you to sue your friend for damages after it has already cost you.

here's the story, my friend said he had an item that he wanted to sell... he said he had the item, and asked me if he can use my account to sell it (he banned from ebay). So i was okay that shouldn't be a problem as long as he has the item (basically i told him he can use it only if he has the item). so i gave him the password to my ebay account and email account thinking it was no big deal. Turned out he didn't have the item, and he was selling it. (Since he didn't have the item in the first place, he therefore "tricked" me so he could use it). Thus under my email account him and the buyer arranged to have the item wired to his bank account. If the buyer sent the itme via paypal. I would have just refunded the money via paypal. but it was sent to his account i really am helpless now! So what should I do? Since i did file a police report. do you think that when and if i have to sue him that my case would hold ground. (basically i want to know that if he's partly legally reponsible for the transaction)

You gave him permission and you are responsible. Then you may be able to go back and sue him if you can prove such an agreement existed. Either way you are in debt to the buyer.
