ebay auction fraud within state lines

I recently purchased a computer lot on ebay on 09/05/05. I still have yet to receive the item. I filed a complaint to ebay and it looks like thats not going to resolve the problem. I have proof that the seller received the money order and he has already lied to me twice about shipping out the package. The seller only lives 220 miles away from me in Pennsylvania. What rights do I have or what action can I take against him?

How do you know they lied about mailing it? Maybe it got lost in the mail.

Seller told me right after he got the money order that he shipped out the package. I replied and asked for a tracking number and he said he was sorry he didnt ship out the package, he was too busy, and was going to send me extra computer parts. He said this the end of September and i've asked for a tracking number three times with no reply. FedEx ground always has tracking numbers on there packages and that is the method of shipment me and the seller agreed upon.
