ebay car misrepresented, title not done correctly

What is the name of your state? Illinois, I bought a VW on Ebay, seller said everything was excellent except a little surface rust and a small crack in the dash. It took the trucking company so long to get the vehicle to me that it was over the limit for purchase protection. I had tried to get out of the deal due to family issues, Mom was in hospital for surgury and he said he would sue me, so I went ahead with the deal. When I tried to put the title in my name I couldn't. Explained exactly what they needed and he said he would overnite or express mail the info, still haven't received it, going on 1 week. Took the car to a VW repair shop, it had alot more rust that mentioned, 3 dents not mentioned, body filler not mentioned, tear in the drivers seat, he said sorry must have missed, headliner drooping, obviously this is not excellent. What can I do ? :(

You bought a car sight unseen and now you have complaints. If you bought the car "as-is", you have no claims. Perhaps next time you at least look at the car before buying it, better yet, have it inspected by a certified mechanic.

Why would anyone buy a regular car off ebay? They are a dime a dozen where you live? The only kind I'd buy off ebay is a classic like a 70 RR or a 67 Chevelle SS and you can bet your ass if I'm paying 28k or 30k for that car I will fly to where it is, and go over it before full payment is made then have it shipped. If your spending big dollars whats a few hundred more for a round trip flight?

meow ~ You need to learn some respect! racer gave you what you are going to get on this site. And since IAAL has not chimed in yet, "let" me do it for him - Isn't it a pisser dealing with unseen people across state lines? Don't buy across state lines!
I can confidently say that because that is what I was told. I learned my lesson and do not shop on ebay anymore.
I know that does not help you, but you will spend a lot of time and money trying to work this one out, if you can.

What was sarcastic about what racer72 posted? It's factually correct, and isn't the slightest bit sarcastic -- it's just not what you want to hear.

Well I guess I'm on the wrong site, I don't need to hear what I shouldn't have done, I need to know what I can do know, if I have any recourse. His remarks are not what I want to hear, I already know I screwed up. I don't need it rubbed in my face.

You got your answer as to what you can do now, at least with respect to the car itself:

"If you bought the car "as-is", you have no claims."

Nothing, unless you bought the car with a written warranty. You own the car.

As far as getting the title is concerned, well, if he won't give it to you, you can either travel to where he is located and sue him, or you can see if your state has provisions for titleing and registering a car where the original title is unavailable -- contact your local motor vehicles department, they probably have a system for getting a car titled and registered in such cases -- it probably won't be easy, but there will be a way.

Unless you have specific documented representations from your seller...and some kind of warranty or agreement to correct specific problems....you don't have much to go on. If you have all that you can file a small claims suit in your seller's state and take your chances. You'll have to figure out the cost of doing that. It's not impossible to have a deal like this undone, but you'd have to return the car in addition to making those trips (plural) to his jurisdiction.

Parts for VWs are really cheap, so I'd look at replacing anything that is rusted or bondo'd. The rest can be repaired.

How much did you pay for this magnificent machine, and what year/model is it?

The title is a different matter since it is the document that shows ownership. If he refuses to send it contact his state's DMV and AG office.
