I live in New York, buyer in North Carolina.

I sold a computer processor back in December. Buyer purchased it on Dec-19.
The processor was new. I did open the package to inspect it, but immediately returned it to the box after extremely careful handling. There was nothing done to it.
I double checked everything before shipping the processor.
I shipped it out, everything's fine. Nothing was heard from buyer until Jan-19, and he claims the processor pins are damaged. He wants a refund.

Am I obligated to refund him after so long? I can guarantee that the processor pins were FINE when I shipped it. I don't understand how they could possibly be damaged.

Any advice is GREATLY appreciated.

Tell him to ship it back to you first to so you can verify the damage. You probably won't hear from him again after that.

When you sold the item, did you offer any warranty or a return policy? If not, be friendly but firm and state to the buyer the amount of time that has passed. If he persists, offer to review any photos or documentation he has and have him file a report with the shipper in case the shipment was damaged during transit. Legally speaking, he is unlikely to win such a case because most would view more than a month to be beyond a "reasonable time," not to mention that in order to sue you, he would have to come up to NY for the case.

Having said that, however, if he paid using PayPal, watch out because PayPal may rule a "significantly not as described" dispute in the buyer's favor. In such a case, the buyer would have to return the item to you and once PayPal receives confirmation that the item was returned to you, they will automatically debit your account and credit his.

If it was new when you sold it, wouldn't it fall under the manufacturers warranty? Where did you get it from?

I would direct them to the manufacturer and see how that goes.

If they paid for it via PayPal, they have 45 days to file a claim against you no matter what. After that its theirs. They might leave you bad feedback.
