ebay mix up

i won an xbox 360 from ebay. The seller happens to have a store online at www.wbdeals.com. I did not use paypal to pay for this item i used my bank card from national city. I paid 278 dollars. When my package arrived it was a psp. The seller is now not replying to my messages. I used his website to file a "ticket". I filed two of them to be exact and emailed him through ebay. What do i need to do to take him to court? the psp is only worth about 100 bucks.

What do i need to do to take him to court?

You need to sue him in his state, so find out which court handles small claims, then see if there are forms online to download at the court's website.

Go to ebay Safe Harbor and follow the instructions.

If you paid by credit card directly (as opposed to PayPal) and you've attempted to contact the seller and they did not resolve it, you go to your credit card company. Ebay won't do squat for you anymore (and further even when they did have a protection plan, they still expected you to try your credit card company first).

I've never had a credit card company that has *EVER* had a problem with this.

call the number on the back of your bank card

i have had this problem before

they will issue you a temporary credit and if it still is not resolved with in 90 days it becomes permanent

if you get it resolved just call your bank again and they will put the money back into the seller's account

** important **: the letter they send you to sign must be returned with in 10 days of the date on the letter ,if there is a branch of that bank in your area you can bring it there also you may be able to fax it back

In addition to what's already been said, get his phone number through eBay and try calling.
