Ebay Motors Buyer Protection - Laughable!

What is the name of your state? I am in Texas!

I recently purchased a car from Diamond Motors. I felt confident in my purchase because:

A) It was a local dealer
B) All the "Buyer Protection" advertisements all over ebay Motors.

Less than two weeks after my purchase, my car broke down on the side of the highway. I had it towed to the closest manufacturer dealership.

Long Story, short. The dealership told me it would be $4900 to repair my $8900 car.

Here is my problem:

A) My car came with a warranty, offered by SquareTrade. I gave the claim info to the service rep. He spoke with Squaretrade. AT first, they said they would be sending out an inspector to confirm the repairs needed. Then they called back 15 minutes later to say none of the items that needed to be repaired would be covered under this warranty except for one, which just so happened to be less than the warranty's deductable. SO CLAIM DENIED!

B) everything you read on ebay motors says to try and resolve with seller first. I attempted this route and was told, "Hey, old cars break down!" So even though his ad claimed "Everything works" Runs great! Air is cold, great service history! (repair shop claims this car's service needs had been severly neglected) he is washing his hands of the whole thing.

C) So I tried the SquareTrade arbitration route. They want $100 just to initiate the claim and as far as I can tell from the copy is that I might be able to change the feedback I left. Wow! Thanks for nothing!

D) So I have filed a complaint with Vehichle Purchase Protection. Still haven't heard a word.

Basically every path I have gone down to try and get some sort of restitution has been a deadend. Am I just S.O.L.? Has anyone had any success with Ebay motors and fighting a battle against shams? Any advice would be appreciated.

If the dealer is local, why not simply pursue the dealer in small claims court?

Certainly an option, however my point was regarding the Ebay Motors buyer protection and how weak it is, despite all their advertising to the contrary.

I'm not sure how to proceed with a small claims court. Do you think the description of the car was misleading and I'd have a case based on that?
