Hello,I won an ebay auction on 4/05/2005 for $3.325.00 to a 100% positive feedback member,same day I was contact from Ebay saying i must pay for the item,iwas contact from the seller who sent information about paying,on 4/06/2005 a wire transfer from my checking account for $3.325.00 was made to the seller checking account on a cincinnati OH Bank,after payment was recived,seller did not send the item and no replys email,reported to Ebay security not responce,reported to (IFCC)no reply yet,i have all the member info include address and bank account information in Cincinnati ,OH. Thanks.Ebay Item, number: 4980937305 .what can I Do?

Just to let you know just because he had 100% feedback at the time doesn't mean he is all great considering he only had 7 feedback.

File a Paypal claim. Since the item is over $100.00 they will automatically take the whole payment from his account and Paypal will hold it till he can prove he sent the item. If he cannot prove it then the money will be returned to you. Even if he doesn't have money available in his Paypal account then Paypal will still take it but they will make him pay Paypal back.

Please keep in mind if Paypal does find in favor of you, I do think it can take up to 90 days to recieve your money back.

If you have exhausted all 'normal' demands for payment or delivery, your only real recourse is to file a lawsuit in the sellers home county.

One thing you may have overlooked.... the sellers 'rating' is over 4 years old. The last post to his account was Jun 04, 2001!!
And that NONE of them were for anything he sold.... all for things he purchased!!

The only thing left then is Ebay claim which you said you filed. This is almost like Paypal and in this case they have to respond to Ebay. If they don't I think Ebay then credits you but puts a charge on the sellers account. I am not sure as that is a new process.

Why didn't you notice that this seller is located in VA but asked you to wire transfer money to a bank in OH? I'm betting somebody got this person's eBay login and used their account to post a fake auction. I'd contact the bank where you wired the money to.

,Today after 28 days of reciving email from Ebay saying that i must pay for a won item for $3.325.00 and follows all the actions required by Ebay and after member get paid,Ebay sends me an email saying that not preforme any buy from that member and wash their hands ,they erease all information that they have avaliable from their page,living me with a lose of $3.325.00 and all the steps that i made thru their page,like reporting and filling all forms worth nothing to them.........Can I fill a lawsuit againts Ebay and his member or I Just have to keep my mouth shout and wait for frauders take a years of family savings....................??????????

Of course you can. You can file against anyone you want. However, any claim against eBay will likely be dismissed.
You can however, file against the person who scammed you.... if you can find him.... and if he has non-exempt assets to seize in trying to recover your (hopeful) judgment.
At the least, contact the local PD where he lives and see if they will accept a criminal complaint.
