Hi all, first post, just saying hello.

Anyway, a couple of months ago, I sold a cell phone on eBay. I clearly stated that there was something wrong with the phone, that it could be just a replacement battery, or the whole phone is shot. So someone buys it, I ship the day payment clears. Before I get any feedback, I get a dispute filed through Paypal. So I email the user asking why, and he said he was under the impression buying a new charger would fix the phone, which was not stated whatsoever.

So never having a dispute filed before, I never responded with 'my side of the story', which there is no 'story'. What happened happened. So I give no response to Paypal, and clearly he wins the dispute, and I'm not gonna fight that. I put the money on Paypal, and he takes it immidieately. After a few days of receiving no phone, I call Paypal, and they say they can take no further action, only because I did not respond to the dispute. But they also told me that he filed an "Item not received" dispute, and not "Item not as described".

I emailed him numerous times asking where my phone is, and May 5th responds saying he will get back to me within 48 hours with shipping info, and 5 days later, I have nothing. Obviously here, I can't be left with no money OR a phone, so I believe I do have a case here. Your opinions (or facts?) will be GREATLY appreciated as I am trying to settle this as soon as possible. Thank you all.

If you're going to play in the ebay/paypal sandbox you're going to have to learn the rules.

1. Never ship before receiving payment.
2. Always ship in compliance with the Paypal SPP policy.
3. Always answer the disputes even if you have nothing to say. The presumption is that you are guilty of everything if you don't even answer.
4. Always REFUND via the paypal sytem.

For SNAD complaints (if he had done that), he would have had to give paypal DC/Tracking info to show he sent you back the phone (or at least some package). For INR complainst you would have one if you had complied with the SPP.

Obviously you *CAN* be left without the money and the phone.
That's where you are now.
