Ebay Problem Please Help

I recently decided to purchase an account for the MMORPG World of Warcraft. After purchasing the character and logging on i noticed the description of the character, and the actual condition of it was not the same. I contacted the seller, explained this and requested a refund. He said it was impossible for the condition to not be the same and called me a scam artist trying to get the character for free. He will not give me a refund and recently the account that i purchased information and login password has been changed. It states specifically in the user agreement of the game that buying or selling of accounts is 100% illegal. Knowing all this do i stand a chance at prosecuting him, or should i try to handle it some other way or do i take it as a lesson learned ?

You answered your own question. If it says in the User Agreement that it is 100% illegal to buy or sell it and you bought it illegally then [a] you have no case and if you were to take it to court you may end up being prosecuted [sp?] I would take it as a lesson learned.

i thought so. The character is property of blizzard inc. i was paying for "time invested" I did get the ebay accoutn shut down, but there is NOTHING i can do ?
 
Not if you did it illegally no. You would be stupid to try to pursue this in court for the fact that you could end up paying for all sorts of fines and whatnot. Seriously, I understand that it sucks and you feel as if you got duped but, take it as a lesson learned and don't go out and do it again.
