I made a purchase on ebay for a pair of boots that were described as "suede". I emailed the seller prior to finalizing the order regarding shipping charges because the boots were needed for an event. I paid for express shipping, and the total was $51.48. Upon receipts of the boots, I discovered the boots shipped to me was "velour" and not "suede" as described. I immediatley that day e-mailed the seller, and within 48 hours the seller responded with an apology for my inconvenience, and requested that I provide them a fax number so that they could fax me a return label. I provided this information to the seller. I received the shipping label and attached it to the box. The merchandise was shipped UPS. The seller acknowledged receiving the boots back via e-mail. The seller first offered me a credit. I said no. I wanted a refund. I then responded to the seller by e-mail which included a copy of their return policy which stated if the product value exceeded $9.99 and the product was shipped back within 10 days that a refund would be allowed. The seller then came back and offered to give me a refund for the product only, excluding the shipping that I paid. The seller also argued that the boots were inspected by their quality assurance department and that it had been confirmed that I received the right product. I responded that the product received was not as described. I followed the steps listed on ebay regarding disputes, however, it did not work. My next step was to get pay pal involved since I paid for the boots thru my pay pal account. I now have been dealing with pay pal and the seller going on 2 months, and recently the pay pal representative stated to me that they had made several attempts to contact the seller, but that the seller would not respond. They stated that one of the requirement when filing a dispute is for them to confirm the merchandise had been shipped back to the seller, and because the seller has failed to respond that there is nothing they can do. Therefore, at this point I am without money and without boots. Please advise.
