What is the name of your state? Wisconsin

Me and my husband saw an auction on ebay for a car. We went to Milwaukee to view the car and we put down a downpayment for the car. The guy said that he would cancel the listing and sell us the car. We have a receipt for the down payment and what we owe and now...come to find out he claims he could not figure out how to end the auction and now the car was sold to someone else. But he claims that we can still buy it for what the high bidders bid was. Can I legally go after him for the price that is on selling agreement he wrote out? Or should I just take my deposit that he says he will return and run. Please help!!

you can always sue him for the car. you have a contract. the question to ask is it worth the cost and time to do it?
