Ebay seller never had the goods

I was the winning bidder on an Ebay item however the seller now tells me they never had the item they listed. At no point was that mentioned or shown anywhere on their listing, they claim to have been looking for it from some place other than ebay but have been unable to locate it. I want the item not a refund what are my options? I have found the item elsewhere but costs far more than my winning bid, should the seller be made to buy it & give it to me. I have contacted Ebay who are investigating but really want some 'outside' help. Surely this is fraud?????

I paid by Paypal & I believe I can get my money back that way but thats not the point. This person has no moral compass he sends offensive emails, name calling, & outright bullying surely Ebay should be able to do something? Surely America has laws against false selling, keeping peoples money must surely be theft! I entered into a contract in good faith & this seller is allowed to get away with insulting buyers & keeping their money**************.were I to refuse to pay all hell would break loose.

File a complaint with eBay and PayPal to get your money back and move on. You can't always get what you want.... And I'm sure you're old enough that your wants won't kill you. Besides, the nature of eBay dictates that someone else will list this item at a lower price at some point in the future. :rolleyes:
