What is the name of your state (only U.S. law)? I am an ebay seller and I have had in the last month 4 buyers bid and win auctions and then not pay for the items they won. I have not shipped there items to them but as ebay states it is a legal and binding contract but can do nothing to the buyer other then to maybe to restrict there buying privileges. I had 1 buyer that bought $140.00 in items and that to me was the last straw. I can and have stared an unpaid item dispute on the buyer but that really only get my selling fee back maybe. Can I take this to small clams court?
This may sound bad but I want this buyer to pay for their items that they won. Can you tell me if I can take this to court?

The cost to sue will far exceed the high bid in auctions. File the NPB dispute, you will get your money back and can relist the item for no charge.
