eBay told me that i am a fraudulent seller

I am not sure if i can find any help here, but i wanted to give it a try.

I was selling 4 different Michael Jordan Rookie Cards on eBay (worth about $800 each), unfortunately the listings were removed without notification from eBay. I really need the money and so this is a very bad situation for me...

I wrote the customer service and received the following answer:

"Hello,

Thank you for writing.

I apologize for any inconvenience this may have caused. We are not in a
position to judge the authenticity of items. As such, we cannot say for
certain whether or not your card is authentic. Unfortunately, there
were certain indicators in your auction that are common with known
fraudulent listings. As a consequence, we cannot allow the card you
have listed on eBay.

If you get your card authenticated by a reliable third party grading
service, you are more than welcome to relist it on the site. If not, I
am afraid you will not be able to list such cards on eBay.

eBay also does not permit reprints to be listed unless the seller
complies with the following:

1) The title of the auction must include the word "reprint"

2) The item description must state that the card is marked as a
"reprint"

3) The item description must include the year the reprint was
manufactured

4) The item description must state who manufactured the card

5) Any images must show the back of the card and clearly show that it
is a reprint

Thank you for your understanding and cooperation in this matter. We do
wish you the best of luck in all your eBay trading experiences.

As far as i understand eBay does not allow me to sell ungraded cards - in europe we do not have grading companies, to get cards (of this value) graded in the us would cost me about $300 for each card as i would have to send them insured to the us, pay for the grading, insured shipping to europe + tax for importing valuable items (about 20-30%).

Is there anything i can do? Especially the fact that eBay told me that it is very possible that i am a fraudulent seller makes me really angry :mad:

? Ebay can allow whatever they want. So many fradulent sellers are around there is no other way to manage the listings. No case

Yep. Take your bogus cards into a sports card dealer in Austria and let him determine their real value, if any.... and then sell them to him.

How did you word your auctions? I know from buying tons of Ty beanies on there, which I collect, that they do not allow auctions that have any type of authenticity disclaimer.

If for instance you said: I am not sure if this card is authentic, or what they are worth.

Then that is a disclaimer and they will remove the auction. Doesn't mean you are a fraudulent seller, they didn't suspend your whole account, just that they weren't sure about those items.

You either have to say it is, or isn't the authentic item.

They will permit an auction that says "This is a genuine, original Ty beanie."
or "This beanie says Ty, see for yourself."

But not one that says "I know nothing about beanies, so I don't know if this is a real one or not!"

Yep. Sometimes we have to when people DON'T read the messages before them and try to answer a post that doesn't qualify.

Unfortunately there are no sport card dealers in Austria who sell single cards - Europe is a little bit different. :eek:

We also cannot buy weapons in a sports shop, unbelievable isn't it?

Okay, da du anscheinend ein Deutschamateur zu sein scheinst... Da ich auf eBay USA verkaufen wollte dachte ich dass auch US-amerikanisches Recht zutreffend sein würde, wenn ich mich da geirrt habe tut mir das nicht im geringsten leid - ich bin kein Jurist.

I did not say anything like that in my auctions. I am sure that these cards are legit as i bought them from certified sellers in the US...

Anyway, i will re-list them on eBay Germany - there should be no problems, as collecting is not that popular and connected with fraud issues in europe.

Sorry for my poor english. :(
