Ebay vehicle buyer refuses to take possession.

I placed a vehicle for sale on Ebay with a
Buy it now
of $XXXX and
Buyer responsable for vehicle pick-up or shipping.
Listing also stated that vehicle sale required a $XXX non-refundable deposit and that vehicle was to be paid for in full and removed within seven days. It was also posted in the listing to ask questions before purchasing with a phone number clearly posted. I am always extremely forthright in my item descriptions and terms of sale. I have excelent feedback and have sold other vehicles to buyers as far away as PA. <p> Buyer from California purchased vehicle July 4 using
Buy it now
and paid the deposit through Paypal. Buyer called the next day and asked me what I knew about shipping costs. I told him I didn't know anything about shipping a vehicle. I offered to seek quotes and forward them to buyer through email. I also noted to the buyer that I wasn't responsable for shipping and that I would not hold his hands in arranging it. We ended the conversation with that. The next day I left for a camping trip. When I returned on July 9, I sent the buyer a reminder of the contract nature of the purchase he had agreed to by using

and requested the balance of the purchase price. Buyer sent the balance of $XXXX through Paypal the next day, the 10th. On July 12 buyer left a message on my answering system that after thinking it over, he couldn't afford it and wanted his money back. I immediately ceased all verbal communication realizing there might be trouble brewing. I emailed the buyer on the 12th a reminder of the contract inherant in his purchase and asked that he remove the vehicle. The next day Buyer filed a paypal complaint for
non-delivery
. I won the claim. As far as I am concerned, it was a fair sale .... the van is the buyer's and the money is mine. <p>
Here is my problem now and all that I am concerned with: Buyer refuses to take physical possession of the vehicle. Vermont DMV says I can't just send him the title and that it has to be conveyed to the buyer in person and also that I am responsable for the care and protection of the vehicle till whenever he comes to take physical possession of it. What the heck can I do to force his performance of his end of the contract - removal of the vehicl from my property and physical possession ?

The buyer has forfeited his rights by not picking up the vehicle within the 7 day period in the purchase agreement. Keep the money and sell the car to somebody else.

And then get sued for selling property that is NOT yours.
And also, if you sell that vehicle to someone else for MORE than your first deal, you owe that overage to the current OWNER.

Bottom line... there are LOTS of inherent problems in doing 'business' this way. Contact a local attorney who can review ALL of your facts and give you valid advice.
