eBay. Won car, HBL TysonsCorner, VA dealer already sold it 2 days before.

SELLER: HBL Mercedes Benz Dealer in Tyson Corner Virginia Also.

Here's the simple verson.

On 6/5/06, I won an eBay auction for CLS55AMG Mercedes (reserve met) $79,975.00
I called dealer to leave 10% deposit on AMEX as required right after the auction ended. Dealer calls me back 15 mins later stating "I'm sorry, the car was already sold 2 days before by someone else, I forgot to put the car aside...no charges were put on your card."

What just happened here? Isn't a successfull bid a legal and binding contract? If so, then can anyone say "I'm sorry?" What recouse do I have? As a dealer can't they get a similar car from another dealer and met their obilgation? It's their fault. I won the car and want it or a similar one to it at the eBay won price.

Please help! Thank You.

Thanks for the info. However, are you saying that if I won the car, then I would not have to buy it even if the dealer has the car and wanted me to purchase it? Then that would be great for all eBayer's if nothing is concrete unless money is exchange.

Go baby to ebay. Click help. Type "seller non-performance". Go from there. Ebay will give you their take on the situation.
