I live in Colorado, my ex and my two children live in Arkansas with their mother, and I was divorced in Missouri. Our divorce papers state that in addition to paying child support I am to put money in an education account for the childrens college. In the papers it specifically states what bank, what town. The money was moved into a mutual fund after my ex withdrew funds without my approval or knowledge for non education expenses. Now the child support agency in Arkasas is getting involved and charging me with back support for the education account because it is in a mutual fund and not in a savings account. Is there anything I can do to have the agreement changed without a huge court battle.

My response:

More than likely, not. By moving the money out of the bank, you breached the Orders of the court, plain and simple.

But, what I'd like to know is how your ex-wife got into the account, and why you didn't take her to court on an Order to Show Cause Re: Contempt.

What was the purpose of her "invasion" of the account ?

always liable my son is 13 his name was on the acct. too. i recieved copies of the withdrawl slips today and it looks like the signature was forged as far as doing anything in court i'm going to contact a lawyer in mo. to see if i can do anything about the missing money. i've been reluctant to because of my kids. it's an awkward situation for me because i feel i'm hurting my kids also. thanks for your reply
