My daughter is trying out for cheerleading at her high school. She recently received her grades and had all "A's" and one 68 in chemistry. In the past, the ruling for all cheerleading tryouts at this high school was an average of the grades together and if they have an average of their core classes of a "B" or above they can try out. My daughter has an 85 average. The student handbook reads as follows this year:
Cheerleaders - Selection
High School
The selection of Cheerleaders is to be held in the spring. Selection is made according to NCA Guidelines that are based on independent outside judging (which counts 80%) and faculty recommendation (which counts 20%). All eligible students will be allowed to tryout. After tryout scores will be tallied to determine the students that will be cheerleaders
In order to tryout for cheerleader a student must: have not less than a “B” average in core subjects for the previous semester and must be maintaining a “B” average in the core subjects he/she is taking. If selected each cheerleader must maintain a “B” average in core subjects the entire year he/she serves as cheerleader. A student average is determined by averaging core courses only. The following are the required core courses: Math, Science, English, and Social Studies.
Then the next section typed below the cheerleader selection process states:
The cheerleader guidelines will outline in more detail the cheerleader’s role, responsibilities and expectations. (available in the Principal’s office.)
My daughter and I signed the High School Cheerleading Constitution/Guidlelines document for cheerleading tryouts at her high school at the beginning of the year. The document that we signed stated that, " Must meet grade requirements in the student handbook". There was no section in the guidelines for grade requirements.
There were about 16 girls (inlcuding my daughter) who were considered ineligible due to the way the handbook read. The school was flooded with calls from parents because of the way the handbook read and it left 16 girls not being able to try out. Well, I was told by the principal that she was faxing me a copy of the guidelines from her office. The guidelines she faxed to me were changed and totally different from the guidlelines that we signed at the beginning of the year. She had re-typed the guidelines adding a section for Grade Requirements between Camp and Behavior. and faxed to me. I told her she falsified a document and she cannot do that. She is granting the other 15 girls, who did not have a B in all core subjects, the chance to try out, and stated in the new guidelines that she just typed up, there can be no grade below 70. She had a first semester average - there can be no grade below 70; then tyrouts during the 5th six weeks, no grade below 70; and then tryouts during the 6th six weeks, no grade below 70; and tryouts during the summer, no grade below 70. So all the other girls were granted the chance to try out now, but not mine because of the way she typed it. This is not the document that we signed at the beginning of the year and she is trying to change it now. She changed the guidelines to accomodate the other participants to be able to try out, but not mine. They called my daughter to the office and said they were sorry she could not try out. I have called an attorney because I feel they are discriminating against my daughter and secondly she falsified a document and changed it after the fact. It was not the document we signed. I have a copy of the document we signed at the beginning of the year. What would you do?
