A) I have filed an EEOC gender discrimination complaint. Briefly, the employer is a larger Florida organization with many offices statewide. My office has never had a male supervisor. I filed complaint but have been told it may be dismissed because there were no other males applying for that supervisory position. The region just lost some non-gender related EEOC actions so they are fighting mine hard to avoid a repeat. There was one other, but he quit and was not eligible for the in-house position. Other men have applied for supervisory positions, got discouraged and quit but they will speak to the issue if needed. Few males get hired in this region in the first place and most leave due to the hostile climate. Any suggestions? I had seniority and was more qualified but that has been discounted because the job description just lists a minumum number of years experience to apply and the chosen applicant had that minimum. Any suggestions around the problem that no other men applied and it will be dismissed by the investigator for this?
B) My work record is exemplary and all my official reviews state the same; but when I requested my reason for being turned down for the promotion again, I found that my supervisor had given me an extremely bad reference (about as bad as it could get). This bad reference was hidden and in direct contrast to all my official outstanding employee records and awards. It even stated I refused to do work that I have been given official credit for having done for up to 6 months at a time. The female who was promoted got a job reference stating she did accept the same kind of work I was not given credit for. Question: Can a lawyer help me get that inaccurate job reference out of my file and keep them from doing it again, especially as I plan to seek other employment now. I would prefer a lawyer help with this to make sure they give me an accurate telephone or written reference. Thank you for any assistance or suggestions as how to best proceed.
