elusive ex-landlords

What is the name of your state?Arizona

I have a former landlord who moved to Alaska before refusing to return our deposit. We have sent repeated requests to their PO Box, and finally got a hold of their physical address and attempted to serve them in small claims court. They refused to accept the service, so we are now looking into a process server.

Two questions:

1. How much should a process server cost across state lines? What if the defendent is elusive?

2. They are selling the house we rented, can we put a lein on it until this is resolved? Do we need to go to court to do it?

Who care's less where the old landlord went? If you are still in the home your contract/lease/deposit etc transferred to the new owner.

No, we are no longer in the house, and the landlord never paid us our security deposit after we moved out. They are now selling their (no longer rented) house. We are having a heard time serving them in our court case, so we want to see if we can stop them from selling by putting a lein on their house, depending on how hard that is.
