In retrieving temp Internet files on my home computer, I have found my wife is having an affair. The nature of the affair includes drug use and is potentially harmful to our children. Are these temp files (copies of emails) admissable in a custody battle to show state of mind? I have also been able to obtain her email passwords and am capable of gaining access to her account. Is anything I find there admissable? Even if it shows willful and premeditated irresponsibility and drug use?

Very serious circumstances. My regrets as to those facts. Especially, the kids.

I'm in NY. Consult local counsel - immediately.
