emancipation in New Jersey
New Jersey - I have followed my divorce agreement to the letter for 13 years - 2 of my 3 children are emancipated and I put them through college. I am not a dead-beat dad.
My son, soon to be 20 yrs old dropped out of high school 3/99 - obtained a GED 4/99
6/99, a suit from my ex-wife was completely denied for a second time
7/99, my son, ex-wife and I discussed his attending The Culinary Institute of America
8/99 my ex-wife appeals the court decision
8/99 I inform my ex and son that I can not honor my commitment until the appeal is finalized. I have tried to expedite the matter, proposed a generous settlement, but to no avail.
1/2000 without my knowledge, my ex-wife enrolled my son in The Culinary Institute of America 1/2000 (he failed 2 classes, passed 2)
5/2000 to now, he expresses an interest in attending another culinary school but has not worked and has not done anything to pursue his goal.
I became completely disabled in 4/2000 with Meniere's Disease and now collect private and social security disability. I am remarried and have a 9 yr old daughter and a step-son. I stopped paying child support in 6/2000 because of no income while waiting for disability. (My son at this point almost 19 yrs old)
BTW, my ex-wife is a CPA - and to further complex this mess, she should have paid me for my share of the home she lives in as per our settlement agreement when my son finished high school back in 1999.
The appeal has still not been heard! There is a court date in July 2001. Recently, in 5/2001, during a motion to dismiss the case, the new Judge ordered that I resume paying $600 child support. I can only pay this by taking money from my step-son's child support and my daughter's Social Security money. My wife can not work because of her own health issues.
Whew! Here's the questions,
Is my son emancipated? Can you site any cases like mine?
Is it fair that I am taking money from my daughter and step-son to pay child support for my son who is now nearly 20 yrs old?
The law suit from my ex-wife is now in the courts for 7 yrs! Is there a limit to this? My legal bill is approaching what she is suing me for. Should I get a new lawyer?
