My husband just filed for emergency custody of his 3 children due to their mother being investigated by CPS for violence in the home and unsanitary living conditions. The court hearing is scheduled for next week and he is working to have her served. He also said the children are being served. I was not aware this would happen. Is it typical that the children are served and do they also have to appear in court? Will they be questioned in front of the court room?

The children will not be served.

CPS will act first, and if needed they'll get a court order themselves from the court.
