Emergency Placement Hearing

My husband and his ex wife have joint custody and joint physical placement. They alternate weeks.

She has taken a job 130 miles away, it went to a GAL, who recommended that the kids be able to go with them.

But the family court commissioner, denied her motion to revise the judgement to award her primary placement and allow her to relocate with the children. But if she, she herself, wanted to relocate, future placement hearing would be needed.

She has since, filed for a de novo hearing.

We also found out today, that she has rented a townhouse in the city where her new job is....the kids said, that on mom's weeks they are going to stay at grandma's house, which has been confirmed by the grandmother....

Now, a court date hasn't been set for the de novo hearing....can my husband still file for a emergency temporary placement hearing and have the kids stay with him on her weeks, since she isn't going to be around, until the de novo hearing is set?

Does the court commissioner ruling stand until the de novo hearing is heard?
