I have received a Writ of Garnishment from a collection agency to withhold funds from an employee's check. HOWEVER, the Writ of Garnishment is very clearly WRONG, in that the name on the garnishment is incorrect. It has the wrong middle name listed (there is no address or Social Security number on the writ). The employee noticed this right away and is claiming that I cannot withhold from his check, because it's wrong. I tried contacting the Washington State Attorney General's office...and they'll "get back to me." The man also stated that it might take 10-14 days for a response. Of course, I have to respond to the creditor within 20 days, and I have payroll next Wednesday! Do I respond with "no such employee" or do I go ahead and withhold, because the names are similar, even though the middle name is not correct?????
