is it legal to lower my rate of pay just because I am a tipped employee? I was hired at a specific rate of pay within the last year my pay has been decreased twice to the tune of a total sum of 1 dollar 35 cents an hour lower. this is not due to poor performance. i am a hairdresser and work in a shop that is a walk in only basis establishment they use a mathematical formula ; sales/service minus hours worked at rate of pay times 42 percent so i am at rate of pay well below minimum wage. I cannot control the amount of people that walk in the door of my shop if we took appts it would be different this is a glaring example of corporate greed and employer unfairly taking advantage of employee they have set unrealistic standards that require me to concentrate on quantity not quality the more haircuts i give the better chance i have of "making commission" however what if its a slow day slow night or just a slow time of year my buisness is very unpredictable and i refuse to compromise my standards for quality to my customers and there fore I am penalized !!! is this legal!!!???? Burger king workers make 6 fifty how fair is that I am in New York State
