Greetings all. From 1997 until 3 weeks ago, my wife was an office manager/tax return preparer (she also held other titles, such as RDO, DDO, etc.) for an emerging national tax chain. They currently sport over 100 offices, mostly eastern / midwest US. In any event, she was removed from her position 3 weeks ago, with her boss claiming that she was embezzling monies from the business and stating that they had video evidence.
This was not published to a third party, so no slander at this point (I believe). She is also not protected by an employment contract, so again, no protection there. This situation changed recently, as my wife found out from a former client that the new office manager has been telling clients that the reason my wife is no longer with the company is that she was caught embezzling money. Amazingly enough, no police reports or charges have been filed (I'm assuming that that is a direct result of the fact that she didn't embezzle money) nor do there appear to be any charges forthcoming. We certainly aren't living off of the income generated from that job.
Long story short, is this actionable slander and who would be the target of the suit, the new manager or the employer himself? Should we fight this for the simple sake of protecting her professional reputation? Any advice would be greatly appreciated and thank you for your time.
