What is the name of your state? Georgia Fell and injuried head-neck. Employer contacted attorney and wants to settle before diagnosis. When do you settle?

Hi,not real sure about something you said.Did your employer call your attorney or thiers? If you call the labor board in your state they can give you information, call and talk to them on the phone or you can ask to come in and speak with someone one on one about what is going on.I learned after my accident that it is a great place to start in getting information concerning w/c and your state laws.Good luck to you

What did your attorney say? Without a diagnosis, what is the settlement being based on? I would suggest getting a diagnosis before entertaining thoughts of a settlement.

It is never a good idea to settle prior to a diagnosis and prior to reaching MMI (maximum medical improvement). You need to consult with a w/c attorney.

And this happened at work?

In most if not all States, the State's Worker's Compensation Divison must approve settlements of all worker's compensation claims. I seriously doubt the State would approve a settlement at this point and I don't know what to make of the employer and/or their WC carrier even making this offer.

In any event, since you have an attorney, you should let him/her advise you.
