Hi, I am voluntarily resigning from my job as an insurance sales agent. My current compensation is a base salary and monthly commissions. Commissions paid each month are earned from insurance premiums that the clients pay the previous month, For example, on April 30th I will get paid commissions that were earned in March.
That being said, when I resign as of May 1 and provide 14 days notice, I should expect to be paid commissions on the next pay cycle which is May 30th. Even though I will not be employed here at that time (May 30), the commissions being paid were earned in April, when I was employed here. Does that make sense ? Could you please provide some guidance. ?
There is no employment contract other than a signed company employee handbook.
Employer has withheld these earned commissions from salespeople that have left in the past.

thank you,

Previous brokers that have left have told me they did not get paid the last commission that was due them.

sounds like a DOL wage violation to me.

From the Employee handbook**************....

"Broker Employees who voluntarily terminate their employment will have their termination time period reviewed on a case by case basis. Voluntarily terminating employees will be given their final paycheck at the next regularly scheduled payday"

Then give them a call. I don't agree, but it can't hurt to ask.
