Employer won't allow vacation

What is the name of your state? CA
I work for Delta Dental here in Sacramento and I'm a union member. My job entails processing claims with quota. Well, the company's saying our claims inventory is high so they're rejecting all vacation requests.They use to allow two employees out on a given day. My job is stressful and since summer is coming, I think a week or 2 of vacation will help me clear my mind, relax and enjoy. But they're so pickle minded, they won't allow anyone to use their much deserved vacation. I've worked for this same company for years and suddenly they're changing the company rules on us. There's a new V.P., director, manager and 3 supervisors on board and all came from HealthNet. Since these gang of misfits started running our dept, life has been hell. They started changing company rules as they see fit and one of them is vacation. They want us to use our FMLA or FCLA to get our vacation. Is this legal? The union in the meantime isn't doing anything about it. Do I have any recourse here? I really don't want to defraud the state by faking illness just to get be on state disability to get my vacation. I consider myself a honest person and seems like the company is forcing me to scam the state.:confused:

Vacation is not required by law. It is entirely a voluntary benefit on the part of the employer, and it is entirely up to the employer when and how to permit it. It is not illegal, nor is it even uncommon, for vacation requests to be refused during high volume periods.

Unless your union contract specifically states that you have the absolute right to take vacation whenever you want to and your employer has no option to do anything except approve your request, you are out of luck.

I'm glad to hear you don't want to defraud the state, since being fired is only the start of what can happen to you if you do. You can also be fired for FMLA abuse.
