I and several co-workers have worked contracted to a major Automotive company for 7- 10 years. A few of us have non-technical degrees. We work on their company site as part of their company department, right next to co-workers who do the exact same jobs, most of which also have no technical degrees. We do not get the holidays, the bonus pay, the stock options or any other of the substantial employee benefits or security that the real employees get. The department has had openings for jobs, but we are excluded from applying, because they are only open to other company employees and they say they can only hire people with technical degrees. Being that we have been doing these same jobs for so long, can we sue to be hired in on the basis of common law?
