I was hired under a minority program to introduce minorities into the work place. Recent audit findings resulted in non-compliance with EEO, local, State and Federal agreements. Company in the past was very discriminatory to employees so the organization is attempting to make it right prior to renewal of their commitments with these agencies. I did not realize that I was in a minority program until I was hired and moved.

My company is currently going through a re-alignment now (new fuzzy term for re-organization). Employees will be going through the banding process (forced ranking) in A, B or C classes. It has been explained that the jobs that go away may include all or some of the classes but the company would like to keep the higher performing workers. I have had great evaluations in the past so I’m not so concerned. Our organization reports to federal and state and federal agencies.

My supervisor explained (in a meeting with my team) that there was a joke going around about the forced ranking system and that she wanted people to be sensitive during this time. She proceeded to laugh historically (because she was tearing up) and proceeded to tell the Joke A= (State, not mentioning here) Natives B= Brothers and C= Caucasian. Everyone in the room is Caucasian and laughed historically except me. This is just one example of the racist comments that offend me in this work place.

Our department manager recently demoted a couple of Native friends of mine. It was explained that during the re-alignment that they really do not have anything to worry about because they are Native. Yet he turns around and gives the jobs to a contractor (whom they are enamored with and happen to be white). The employee understood the manager to mean since they were native and the white individuals are more open to the layoff that they (Minority Employees) would be safe.

We are exempt employees (non-union) although sometimes our company has Union Contractors work for them. I have documented numerous other offenses but just mentioned a few of them to be brief. What should I do when these things happen? How do we protect ourselves?

I'm not personally familiar with the minority programs you mention, although I have heard of them. So I can't really give you any information specific to them. However, for the most part, if you feel that racial discrimination or harassment is taking place the agency that you go to is the EEOC.

I absolutely feel that they make decisions based on race and because of the rift that has created (culturally) in the organization that seperates people. Can they do that?

I feel bad when I hear racial comments like that, especially coming from my superior (and my supervisor obviously thinks its funny). What will the EEOC be able to do? why not seek legal council?

Well, for one thing, the EEOC is free.

The EEOC will investigate, and determine whether or not there is a case for discrimination. If they find discrimination, they may or may not take the case on for you. If they don't, they will issue you a Right to Sue letter. You then have 90 days to file a lawsuit.

Why pay for a lawyer now, if there's a chance that the Federal government will pick up the tab? Filing a complaint with the EEOC now does not mean you can't file a lawsuit later.
