I am a licensed child care provider in CA. A normally reliable parent stopped paying me when she began having marital problems. I don't know her current status. I do know her husband is in the Army; he was newly out of basic training when his children were in my care. Is the small claims process the same when a military person is involved? I'd like to know if I pursue a judgement via his military base or through small claims court, or both. Technically, both parents are responsible for the bills acquired, not just his wife. If I had a judgement via small claims court, could I send that to his base for enforcement or garnish his military wages?

File in your civil small claims court. The civilian judgment can be enforced from his military pay (US Military Code of Justice). All you have to do is send a copy of the Final Judgment to his Commanding Officer. According to the CofJ, each member of the military is absolutely responsible for civilian judgments.
