I applied last summer to attend the LVN course at St. Philips College. I meet the prerequistes and the college changed the prerequistes and they notified me 3 months later. I was only given 3 months in which to make good on the deficienies. This was not enough time to get the hepatitis B vaccinations which take about 5 months to get.

St. Philips College requires the applicants to get a physical and various shots which total about 300.00 before they can turn in the application. The problem I have with this, is that a person shouldnt have to pay for something before they can turn in an application, only to have the application possibly being denied.

That is like telling a student they have to pay their tuition before they can register for class.

Since I can not afford an attorney I was planning on filing the lawsuit myself. I need to know how to set up the paper work. I know there isnt a premade form and a person has to type up the paper work themselves.

So what do I sue them under?

Thanks for the replies.

The prerequisites are house rules and the college says they are the state mandate that requires that an applicant get these vaccinations and physical exams.

No other college does this, only St. Philips, the other colleges require you to pass the applicant background check before you get any shots or exams. St. Philips does this prior to the application and if the application is denied the person is out of money. Let me make this clear. The application is not part of the tuition.

One is almost always required to pay application fees before on is accepted. For example, Texas State University requires one to pay a $40 application fee, add a few more fees if you plan to live on-campus. Include fees for any off campus classes, library fees, student use fees, I could go on and on. And tell how you are able to enroll is St. Phillips with out paying at least half your tuition? I know SAC required one to pay half to start then you had a month or so to pay the rest. If you don't pay by the first day of class you are dropped. Even in the nursing program you pay by the semester. They don't want to admit a student who cannot/will not meet the requirements.

Even high school kids in the CNA classes have to get Hep B shots before they can work with patients, in fact ALL students in public school must have the Hep B series before in rolling in K-12. I cannot believe you are upset because the school is trying to protect you and the patients. Get your shots and start next term. As far as the shots being expensive, visit your local free shot clinic. The shots are free or on a sliding scale.

I'm not an attorney, but I don't see how you can sue. The school has certain policies. You can go elsewhere if you don't like them.

WEll you certainly have the right to waste your time an money in any manner you see fit.

Under guise of standing which you have none. There are no legal grounds for a lawsuit if the requirements are applied to all students, which, from your post, they seem to be.

The fact that you "SAY" the requirements can't be met is immaterial. I would bet you Dollars to Donuts that others can meet them.

You have no case. Move on.
