My sister paid 4 an AD&D policy w/th supplimental family plan. Her husband was left quadraplegic from rollover accident he never returned home he lives w/th family and he filed 4 divorce. Question is she's a beneficiary on that plan is she still entitled 2 her part of the claim proceeds? Beings there is going 2 be a divorce? Thanx!

As any settlement funds may be an "asset" of the marriage, I believe it would be determined as part of the divorce settlement. Likely the court will consider his ongoing care needs and make provisions for those accordingly. If the court feels the disablity funds will be needed for him to live on, they may grant all those to him, especially if sis is able bodied.
