I know I've posted all this before, but I have other legal concerns now for my boyfriend who was recently divorced.
He was married for 13 years (seperated for the past 3 years). She worked outside the home on occasion. He makes about $35K a year. She also works and makes about $20K. They have no children together.
He was court ordered to pay $680 per month for 36 months. He has a child from a previous relationship that he pays $350 monthly for support. We also have a child together, but no order for support. He gets paid 2 times per month. His first spousal support payment was taken out yesterday. They deducted $340. This left him with $200 for 2 weeks worth of work. HOW CAN THIS BE EQUITABLE? This woman works too. This is twice as much as he pays in child support for his teen daughter. Plus that, his ex got 1/2 the 401K and 1/2 the equity in the house, and when she was ordered to leave the house, she took EVERYTHING. HIS personal possessions too. His high school diploma, personal tools...you name it.
He is filing contempt charges against her for all kinds of stuff. His divorce is on appeal. He got stuck with her utility bills before they were married and all the debt. She got all the money and assets. HOW FAIR IS THAT?
Also---It was my understanding that Ohio has a limit of 25% that can be with held from your disposable income. Why is it, then---that Child Support Enforcement Agency can withhold up to 65%???
Sounds like a class-action suit to me. Anyone care to offer suggestions?
