What is the name of your state? Pa
here it is now 38 days i have finally recd the list of damages and they come to 3,727.35
the landlord claims we took her fish tank, i dont have it, made a police report to this
also asking us to replace a flooring that was ripped prior to us moving in and also to fix a toilet paper holder that was fixed prior to us moving out.
hubby is still over in kuwait, what happens next, perhaps make payments to get this over with or just wait until hubby comes home
any suggestions

Hmmm.... according to PA L/T statutes, the landlord has only 30 days to give you the list of damages. Failure to do this forefeits the landlords rights to collect on the damages.

You mentioned 38 days, which should be past the time allowed. Be sure you look at the actual dates. If you moved out March 1st, the landlord has until March 30th to send the list. That doesn't mean it will be delivered to you on the 30th. Either way, I believe they have 30 days to drop the letter in the mail, otherwise they shouldn't be able to collect on said damages

Oh, and I'm no lawyer. I only know the above facts because I'm going through the same problem with an old landlord.
