I live in Austin, TX.
Back in April, I sent a check for my yearly dep on my Roth IRA to Etrade. Instead dep into that account they deposited to my Regular Brokerage account which i haven't touched for several months (a yr plus). So when I logged in and see that amount had been deposited without realized it was not the right account, I immediately calculated what to buy and placed the limit orders (for long term since it is Roth IRA accnt). Couple weeks later, I logged in and realized they deposited in a wrong account and shares had bought! I requested them to transfer these new security shares to my Roth IRA. Instead of that they transfered funds (money) over which i don't have avail in that account. I have been attempted to contact them several times on the fone, over the emails but only get some idiotic and unprofessionals responses back. I was heavily traveling during April and May and need to prepare for the trips so I did not able to check it so often. So after almost 3 months emails/calls back and forth, finally I panicked to see my shares were sold on my regular account! I called and threated to sue, instead they credit me back 70 dollars while all my shares in my regular account has been sold to cover this money fund transfering that I have no longer have avail in the account. Now the question is can i sue them legally for mental distress and the loss they caused on my regular account (since most of them I bought at high price couple yrs ago). I got so upset so open an account at Amex to transfer all my accounts back in June. Anyway, Etrade sent me a letter recently and said it is my responsibilities to monitor my Roth IRA/ Regular account daily. I said I do not responsible for your firm's mistake. Am i right or wrong on this one? Can I file a law suit against them? Pls advise? I threat to go public and write an article regarding about this matter so public could aware this matter. Can i do this? And what lawyer should I contact to sue Etrade for this kind of matter? Thank you all. Victoria

I'm not a lawyer but, you won't be able to sue. If you look at your account forms that you signed to open an account with E-Trade, you'll find that you signed an agreement that calls for binding arbitration to settle disputes.

ETRADE rip offs

don't be dissuaded by disclaimers .. ETRADE is a border line criminal company that basically steals money (just do a quick internet search)... file the lawsuit anyway because it will start running their legal expenses and they will cut their losses at some point to settle with you.. file criminal charges as well it is the same crime as a street punk robbing you ......
if you do nothing kiss your money goodbye
