My father is trying to evict me from the home that he and my mother own. I've lived in this house since I was born. My mother has stated that the house will belong to me and my siblings once my father and mother pass away. My younger brother and younger sister currently live in the home too without paying any rent at the moment. My father wants to evict me from the house because I don't pay rent and he feels all of his children should pay rent. He also wants to evict me because I don't do any yard work and because I don't clean up the dog's crap. I don't like pets and the pets that are in the home don't even belong to me. He tells me that now that I'm 22 it's time to be out on my own and "struggle" in the real world. This is not to my choosing at the moment because I am in the process of saving up my money to buy a house of my own sometime soon.

However, I will let you know that I don't cause any damage to my home, I clean my own room, I keep to myself, I wash my own clothes, I pay for my own food, I wash my own dishes, I don't make a mess around the house, and I basically keep to myself. I don't go around looking for trouble with anyone in my family, I don't go around being a drug dealer, I don't drink alcohol, and I'm not a womanizer. I pay my expenses, such as gasoline for my car and phone bill, by running my own business(legally of course). I stay active by being engaged in sports. I help coach a basketball team in my city too so it's not like I'm being a burden on society. Saying all this, does my father have a strong chance of evicting me from the house through the judicial system(even though I'm not causing anyone physical harm)? Any information on this matter would be greatly appreciated. Thanks in advance.

My response:

Yes, he can evict you. Why would you think that he can't?

You're an adult. Either move on your own, or wait for the Sheriff to bodily throw you out. Your choice.

At 22 your legal standing is that of tenant. By your own admission you are saving for a home so its time to start looking for one. It might not be what you had in mind for a so called dream home BUT your first home will be just that YOUR FIRST HOME and later on as you find you will want something different you can sell. After I had bought my first home and then a duplex on the same street I wanted to do something different so I bought a 4 unit building and lived in one unit and rented the others, then again decided I wanted to do something different and got rid of ALL of it and how here I am. all your parents need to do is give you proper notice that meets your states laws. then if you dont move you can be taken to court and still made to move the hard way. Look for first time home buyer progs, you wont regret it.

My philosophy as a parent was to work myself out of a job. Preparing a kid for the real world is not a never-ending process. Eventually, a parent wants to see their offspring soar on their own.

You sound like a responsible person. Kudos for not being a total slob, bumming cash and slumming with your buds in your room until dawn then crashing.

Keeping a home up and running requires work and cash. Your father wants to see you take the next step and become a contributing member of the household. Not just taking care of your personal expenses but donating your time and/ or money to the household.

As previously mentioned, you can be evicted. Your public record will reflect this and it could possibly put a wedge between you and your family. It's completely avoidable...what can you do to keep it from happening?

And none of that matters at all... It sounds like you are a good kid, and kudos to you as well...

Until the house is titled in your name, you have NO legal right to reside in it unless the owner allows you too. Your father is within his legal rights to demand you leave, he is your LL, and you are his tenant. As stated before, all he needs to do is give you a WRITTEN notice to vacate... Verify with your State's LL/T laws...

Until he gives that to you, you can stay put...
