My tenant has a serious illness and has not worked for several months. He did not pay last month's rent. He has not responded to recent phone calls. (He may be out of state seeking treatment.) I am not heartless, but I have a mortgage to pay. Can I evict him, and what is the procedure in Colorado.

Well it really doesn't matter rent is rent, and you are losing money.

You have to give hima 30 day notice to vacate, and then file legal papers for eviction, and get the ball rolling,

Goto the court house today and start asking question....what if he doenst come back.. then what?

Do you know of any family members who can give you information as to his whereabouts? I assume he has not moved out or had the electricity cut off

As far as i am concercerned, unless he is in a COMA,or DEAD, there is no reason for him not to contact you and let you know what the situation is.

If he is DEAD or in a COMA you would have to include his estate, or his power of attorney in the suit to get the rent
