Here's the situation:

"Jack" signs a year long lease at an apt. complex. "Jack" needs a co-signer (and gets one). Year is up, lease expires and is not renewed. "Jack" stays on a verbal month to month and then gets evicted. Can they punish the co-signer since the lease that was co-signed on had expired? Thanks.What is the name of your state?

Punish? The co-signer of the lease's responsibility continues on a month to month basis as well. So the co-signer would also be responsible unless they had received a waiver stating elsewise.

Yes. Punish. So even though the terms of the lease change because it is not renewed, the co-signer is still affected?

"Jack's" fixed term lease was not terminated by the landlord or the tenant, upon its expiration. It very likely that "Jack's" lease automatically converted to a month-to-month rental agreement with all original terms and conditions in effect.

Thats why it is confusing, because all the original terms and conditions are/were not in effect. That is why "Jack" is questioning whether or not they can involve the co-signer.

In the original lease you have to give 30 days notice and on the month to month you don't. In the original lease you have to pay a daily late fee, and on the month to month you don't. There are a few other minor things. Also, in the original lease it states that the co-signer agreed to the terms until the lease expired. If the lease was renewed the landlord had the option to choose whether or not the co-signer would need to renew as well. But as I said, the lease was never renewed on paper. Thanks.

I don't get it.

The landlord does not have to extend a month to month lease to tenants whose leases expire...

Under the logic that you are describing the co-signer for a termed lease is on the hook for any subsequent leases , whether he co-signs those new leases or not

Thats what I was thinking. It doesn't make sense to keep penalizing the co-signer?! That is what I am trying to figure out though.
