i have a years lease on my apartment. Rent due on march 1st has not been paid along with the rent for april. i have just been sent a summons to appear in the st. louis county circuit court. My boyfriend (not on the lease) has paid this for the past year and a half. I am not working but will be starting this monday. I can pay upcoming rent but not past all at once. Will they give me any options on how to repay? Can they lock me out if the judge tells me to leave that day. I have 2 small kids and no where to stay.can my boyfriend (former, location unknown) be held responsible for any of these costs? Jen, Missouri

They may give you an option to pay in installments if you ask for it because of hardship.

The judge will not tell you to vacate that day. He will give you a period of time. Again, if you show a hardship condition because of the children, the time would usually be somewhat longer than otherwise.

Since the lease is in your name, your ex is not liable to the landlord for any rent; however, if he lived in the apartment during the period that the rent was not paid, he might be liable to you for his portion. However if you don’t know where he is, then that can not help you.
